Understanding the Probate Process

The process an estate goes through once a person is deceased is known as probate. This is overseen by a probate court and is how the estate of a decedent (deceased person) is administered. A probate court must determine if a will exists, whether or not it is legitimate, and if it should be admitted to probate and given legal effect.

The probate process includes collecting assets, paying taxes, distributing property to heirs and liquidating liabilities. Probate proceedings can be either formal or informal. Informal probate proceedings generally do not require a court hearing. The more complicated an estate is, the more complicated its administration will be.
