Understanding the Probate Process

Probate is a legal process that an estate goes through after death to allow the orderly approval of probate documents, handling of assets and payment of debts. This process is overseen by the probate court which will insure that the estate (property) of the deceased is properly administered. The probate court must determine: (a) if a Last Will and Testament exists, (b) whether or not a will is valid, and (c) if the will should be admitted to probate and given legal effect.
The probate process includes collecting assets, paying taxes, distributing property to heirs and satisfying liabilities. Probate proceedings can be either formal or informal. Informal proceedings generally do not require court hearings. The more complicated an estate's assets are, the more complicated its administration can be.
