Understanding the Probate Process

Probate is a legal proceeding that occurs after  a death to allow the orderly validation of estate planning documents, the handling of assets and the payment of debts.  This process is overseen by the probate court to insure that the estate (property) of the deceased is properly administered and distributed.  The probate court will determine such things as: (a) if a Last Will and Testament exists, (b) whether or not the document is valid, and (c) whether the will should be admitted to probate and given legal effect. 
Probate Proceedings can be either formal or informal.  Informal proceedings generally do not require court hearings.  The more complicated an estate’s assets are the more complicated the administration of the estate tends to be.
